The agreement we enter into together

These Terms of Service ("Terms") form a legal agreement between you and Blaze Technologies Inc., doing business as SwiftLogix ("SwiftLogix", "we", "us", "our"). They govern your access to and use of the swiftlogix.io website, any sandbox or demo environments we provide, and any related services (collectively, the "Services").

By accessing the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

If you are using the Services on behalf of an organisation, you represent that you have the authority to bind that organisation, and "you" refers to both you and the organisation.

Customers who purchase the SwiftLogix platform for production use are governed by a separately negotiated Master Service Agreement (MSA), Data Processing Agreement (DPA), and Service Level Agreement (SLA). In the event of any conflict between these Terms and your MSA, the MSA prevails for that customer and their authorised users.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access the Services for your internal business purposes and for evaluation of our products. You agree to use the Services only as permitted by these Terms, applicable laws, and any published documentation.

You agree not to:

• Reverse engineer, decompile, or attempt to derive the source code of any component of the Services.
• Use the Services to send spam, unsolicited messages, or any unlawful or harmful content.
• Interfere with or disrupt the Services, the servers, or any networks connected to the Services.
• Attempt to gain unauthorised access to any part of the Services or any accounts other than your own.
• Use automated scraping, crawling, or data extraction tools on the website without our prior written consent.
• Resell, sublicense, or redistribute the Services without our prior written consent.

Some features of the Services require you to register and create an account. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately at security@swiftlogix.io if you suspect unauthorised use.

The Services, including all software, hardware designs, documentation, trademarks, logos, and content, are owned by SwiftLogix or our licensors and are protected by intellectual property laws. No rights are granted to you except as expressly stated in these Terms.

You retain all rights to any data or content you provide to us. By submitting data through our forms or the Services, you grant us a limited licence to process that data solely for the purpose of providing and improving the Services.

Access to the public swiftlogix.io website is free of charge. Paid access to production features of the platform is subject to a separate order form and the MSA referenced above. All fees, payment terms, and refund policies are specified in the applicable order form.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SWIFTLOGIX DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOU USE THE SERVICES AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIFTLOGIX AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE WEBSITE AND ANY FREE-TIER SERVICES SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD 100). LIABILITY IN THE CONTEXT OF A PAID ENTERPRISE SUBSCRIPTION IS GOVERNED BY THE APPLICABLE MSA.

You agree to defend, indemnify, and hold harmless SwiftLogix and its affiliates from any claims, damages, or expenses arising out of your violation of these Terms, your misuse of the Services, or your violation of any third-party rights.

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if we need to protect the Services or other users. You may stop using the Services at any time.

Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Any disputes arising out of or in connection with these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
